Terms of Service

Please read these Terms of Service ("Terms") carefully before using the Picksy mobile application operated by Picksy ("we", "us", or "our"). By creating an account or using the App, you agree to be bound by these Terms.

1. The Service

Picksy is a social polling app. Users answer binary A-or-B questions, see how other users responded, and optionally share results with friends. Questions are curated by us — users do not create questions.

2. Eligibility

You must be at least 13 years old to use Picksy. By using the App you represent that you meet this requirement. If you are under 18, you represent that your parent or guardian has reviewed and agreed to these Terms on your behalf.

3. Your Account

You must create an account to use Picksy.
Your username must be 3–20 characters, using only lowercase letters, numbers, and underscores.
You are responsible for maintaining the confidentiality of your account.
You may not create accounts for others or impersonate any person.
You may only register one account per person.

4. Acceptable Use

You agree not to:

Use the App for any unlawful purpose
Harass, abuse, or harm other users
Attempt to access another user's account
Reverse engineer, scrape, or otherwise extract data from the App
Interfere with the App's operation or servers
Use automated means (bots, scripts) to interact with the App

We reserve the right to suspend or permanently terminate accounts that violate these Terms.

5. Friends Feature

The friends feature allows users to see each other's individual picks on questions. Friend connections are mutual — a request must be sent and accepted. You may remove a friend or block a user at any time. By adding friends, you consent to your picks being visible to those friends.

6. Premium Subscriptions

Daily Drops — 5 curated questions refreshed each day
Friends — view what your friends picked on each question

Subscription Plans

Premium is offered as an auto-renewing subscription. Available plans (Weekly, Monthly, or Yearly) and pricing are displayed in the App prior to purchase.

Billing and Auto-Renewal

Payment is charged to your Apple ID account at confirmation of purchase.
Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period.
Your account will be charged for renewal within 24 hours prior to the end of the current period.
You can manage and cancel your subscription at any time in your device's App Store subscription settings.

Free Trial

A free trial may be offered on certain plans. Any unused portion of a free trial is forfeited when you purchase a subscription.

Refunds

All purchases are processed through the Apple App Store. Refund requests are subject to Apple's refund policy.

7. Content and Intellectual Property

All questions, branding, design, and content in Picksy are owned by us or our licensors. Nothing in these Terms grants you any right to use our trademarks, logos, or brand elements.

Your username and picks do not transfer any intellectual property rights to us beyond what is necessary to operate and display the App.

8. Disclaimers

THE APP IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, PICKSY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE APP.

10. Termination

We reserve the right to suspend or terminate your account at any time for violation of these Terms. You may delete your account at any time via Profile → Delete Account. Upon deletion, all your data is permanently removed.

11. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by updating the "Last updated" date. Continued use of the App after changes constitutes acceptance of the new Terms.

12. Governing Law

These Terms are governed by the laws of Ontario, Canada, without regard to conflict of law provisions.
